This website (the "Site") is owned and operated by Gearfour.com, a division of Gearfour Technologies FZC ("Gearfour.com") and United Arab of Emirates is our country of domicile.
These Terms of Service apply to the all the versions of the Site, located at Gearfour.com, as well as to any versions of the Site that gearfour.com co-brands with its affiliates and other distribution partners (collectively, "Partners"). You may have arrived at a co-branded version of the Site from a Partner's website, in which case, that Partner will be identified at the top of this page. By using the Site, you hereby agree that you are at least eighteen (18) years of age and bound by all of the following provisions of these Terms of Service.
Gearfour.com operates the Site as an online advertising, research and discovery service for car owners, garage owners, Car buyers and sellers and enthusiasts. Gearfour.com does not sell or buy any services or vehicles directly and is never a party to any transaction between buyers and sellers. As a result, Gearfour.com does not (a) guarantee or ensure provision of any service or any transaction between a Car owners and service providers or partners, (b) guarantee or ensure any vehicle or any transaction between a buyer and seller, (c) collect or process payment or transfer of title on behalf of buyers or sellers, or (d) warehouse, store, ship or deliver any vehicles.
- TERMS APPLICABLE TO CUSTOMERS
i. Registering as a Customer
In order to access certain features of the Services available at Gearfour.com, you will need to Sign-Up with us by filling the Sign-Up form. You will be asked to provide certain information about yourself including your name, contact details and vehicle information. You must ensure that the information provided by you is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively.
Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.
ii. Provision of Services to Customers
Following Sign-Up, we will make certain services available to you free-of-charge. The services will include the ability to search Dealer / Service providers for automotive repair or servicing work, view the details of Service providers, schedule appointments with specific service providers of your choice, contact your service providers, ability to see their service prices and ratings information and the ability to post feedback and ratings in relation to any Dealer / Service provider you have used as a result of your use of the platform. We reserve the right to add, change or remove services from our platform at any time, and may make certain services chargeable at our discretion. In addition, we will have the right to moderate all the feedbacks submitted by you to avoid any foul text or images.
You must only book a service if you have a genuine requirement for the work to be performed. You must only post Feedback in relation to a Service Provider if you have used them as a result of your use of the website.
We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the service without notice.
Upon completion of Service and payment to the service provider, you will be required to rate the garage and submit a feedback to get your car service history. If not done, we will remind you to rate and leave feedback through an email. Car Service history will be updated in your profile only when you rate the service and leave feedback. This can be done by logging into your profile.
iii. Provision of Payment Platforms to Customers
You will pay the service provider directly upon rendering of the services. Payment options provided may differ between service providers, and services offered.
Some services may be made available for booking to you which may include the opportunity to make payments facilitated through our service. Such payments will be made using trusted third party payment gateways.
The estimates of prices shown for services is inclusive of the items described for that particular service and may not include additional services which are discovered to be necessary at the time of service. In such a case the service provider will communicate the changes in scope with you with additional payments required to be made. This communication will involve you and the service provider with no involvement of Gearfour.
Gearfour reserves the right to change prices or services or remove the services at any time, without prior notice.
If you decide to cancel your appointment, you can call the Service Provider directly, quoting your appointment number. If the cancellation is accepted, no cancellation fee will be charged.
iv. Payments, Refunds and Cancellations:
Currently, We accept payments online using Visa and MasterCard credit/debit card in AED (or any other agreed currency)
Multiple transactions may result in multiple postings to the cardholder’s monthly statement. In Case or Refunds, it will be done only through the Original Mode of Payment.
If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. However, the cardholder must retain a copy of transaction records and Merchant policies and rules.
Refunds: We value your experience, and while we are not responsible for the quality of the service provided by the merchant or the experience itself, we will do everything we can to act as a liaison that can assist to find the most favourable outcome for you. So, if something major has let you down you can contact us and we’ll do all we can to make things right.
We ensure to mention conditions related to each deal as clear as possible. That being said, we rely on you, the customer, to choose carefully and ensure that the deal you select suits your needs, requirements, timing and redemption ability. If you decide over time that your Cobone voucher is no longer of interest we suggest you share some group buying love and gift it to a friend or family member.
We cannot process a refund, if:
- If your Deal voucher has expired
- If you make a double purchase
- If you change your plans
- If you accidentally purchase a deal
- If you cite personal reasons
That being said, we realise that sometimes things don’t go exactly as planned. We do investigate exceptional cases and if a refund is the only option, Gearfour.com reserves the right to offer all monies in any mode or as credits.
Cancellations: You can contact us to cancel a deal bought on the website. We investigate and allow only genuine cases to cancel a deal.
v. Our Responsibilities to you
Although we have asked all providers to use Gearfour responsibly, we cannot guarantee the accuracy, integrity or quality of any information provided or received from Partners. This includes any information contained about details of Service Providers who are listed in our directory or quality of service you may receive from Dealers you avail using Gearfour or price of services offered by service providers.
If you use Gearfour you also acknowledge and agree that information contained in any sections are intended to be indicative only and will not form the basis of a binding contract between you and any Service Provider. If you choose to instruct a Service provider to carry out any work with your own set of requirements, we strongly recommend you to arrange your own written agreement with the service providers clearly detailing the work required and the price to be paid. We will not be a party to any agreement or contract which you conclude with a Dealer as a result of your use of Gearfour.
PLEASE NOTE: We (Gearfour.Com) will not under any circumstances, have any responsibility to you or liability to you for the performance or quality of any work which you ask any Service Provider to carry out.
C. TERMS APPLICABLE TO (SERVICE PROVIDERS)
i. Registering as a Partner (Service Provider)
In order to access all the features available at Gearfour.com, you will need to Sign-Up with us by filling the Sign-Up form. You will be asked to provide certain information about your business including your business name, contact details, services on offer, pricing, working hours, location, manpower and infrastructure. You must ensure that the information provided by you on registration is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you provide, by updating your details, in order that we may communicate with you effectively.
ii. Provision of the Services to Partner
Following registration, we will make certain services available to you. The services will include the ability to include details of your business on our platform, the ability to view or receive details of Customer appointment bookings which have been made by the Customers, the ability to accept bookings, share service status updates with Customers and update service details in the service history section.
Full details of the services available to Partners on our platform will depend on the type of agreement entered into with us. We seek to develop and improve the services on offer and hence we reserve the right to make changes to any part of the service without notice at our discretion.
iii. Our Responsibilities to you
You acknowledge and agree that we will enable Partners to register and get listed based on criteria which we (in our absolute discretion) may determine from time to time. In addition, you acknowledge that the number of Service bookings which may be posted or transmitted to a Partner in relation to any particular customer may be limited in number. Accordingly, we do not provide any guarantee that registering as a Partner will result in any commitment to volume of Service bookings
You acknowledge and agree that we do not check or verify the details of any Service Bookings which are posted. We have asked all users to use Gearfour responsibly but cannot guarantee the accuracy, integrity or quality of any information which is posted by third parties.
By registering as a Partner you also understand and agree that Customers who have used your services will be able to provide Feedback and Ratings. Whilst we have asked all users to act responsibly, we may not actively monitor, check or verify all the feedbacks which are posted. Accordingly, you acknowledge and agree that Gearfour shall not have any responsibility to you or liability to you for any Feedback which is posted by any Customer and we will not usually become involved or intervene in complaints or disputes concerning Feedback, although we reserve the right to do so in exceptional circumstances. You may, if you feel that Feedback is misleading or incorrect, contact us and we will investigate but we shall not be obligated to take any action.
iv. Your Responsibilities
You shall be solely responsible for checking and verifying the details of any service booking which is posted before you agree to undertake any work for a Customer and for agreeing with the Customer the terms and prices of services on which any work will be performed.
You shall be responsible for complying with all applicable laws and regulations in your dealings with Customers and for the performance and quality of any work which you agree to undertake for any Customer.
You will be responsible to update the service history on the customer profile for each service provided.
D. Intellectual Property:
All information and content available on this Site (collectively, "Content") is protected by copyright and other intellectual property laws. The Content is owned by Gearfour.com, its Affiliates, and/or their respective licensors and Partners (collectively, "Licensors"). The Content is intended for personal and noncommercial use only. While you may interact with or download a single copy of any portion of the Content for your personal and noncommercial entertainment, information or use, you may not reproduce, sell, publish, distribute, modify, display, perform, re-post or otherwise use any portion of the Content in any other way or for any other purpose without the prior written consent of Gearfour.com. Requests regarding use of the Content for any purpose other than personal, noncommercial use should be directed to Gearfour.com, Al Shmookh Business Center, UAQ Free Trade Zone, UAE - PO Box 7072
E. Limitation to liability:
To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings or loss of data or for any indirect or consequential losses whatsoever arising out of your use of Gearfour.com or any fault or problem relating to or any content received via Gearfour.com.
F. Termination of Services:
You may cancel your registration at any time by informing us in writing. If you do so you must stop using The Services.
The suspension, cancellation or termination of your registration and your right to use The Services shall not affect either party’s statutory right or liabilities.
G. Applicable Laws and Other Terms:
Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
Gearfour.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.
